“It’s an Aggravating World Dealing with Producing Cause and Aggravation: Did Crump change the standard of producing cause?” 
And “Aggravation,” it’s not just for lawyers any more!

 

Completion of this course provides the licensee with an overview the Texas Supreme Court’s standard for producing in workers’ compensation cases. 

  1. What is the burden of proof for producing cause in a workers’ compensation injury or death case?
  2. What does Crump mean for adjusters?
  3. Definition of “Aggravation” of a pre-existing condition.
  4. Medical Aspects of Crump and “Aggravation”
  5. A point to consider discussing: should the adjusters and workers’ comp lawyers submit the issue to the DWC as producing cause, instead of extend to include?

This class has been approved for one hour of CEU credit for adjusters.


Speaker:  Robert R. (Bob) Graves, Jr.

Bob is a partner with the law firm of Burns Anderson Jury & Brenner, L.L.P.  He is board certified in Texas Workers’ Compensation Law by the Texas Board of Legal Specialization.  Bob represents employers and insurance carriers in administrative and court proceedings regarding workers’ compensation benefit disputes, medical disputes, subrogation claims and compliance matters.  He has participated in the legislative process regarding workers’ compensation issues and acted as an expert witness on workers’ compensation matters.  Bob is a graduate of Willamette University College of Law, where he was a member of the Willamette Law Review and Moot Court Board, and Centenary College of Louisiana.  He has been admitted to practice law by the State Bar of Texas, State Bar of Oregon (inactive) and the United States District Courts of the Western, Eastern, Northern, and Southern Districts of Texas.  Bob is a former member of the Workers’ Compensation Law Advisory Commission (Texas Board of Legal Specialization), College of the State Bar, Austin Bar Association and a Fellow with the Texas Bar Foundation.  He was Vice President, Carrier Section, Workers’ Compensation Section of the State Bar of Texas (2017-2018) and he is currently the Chair Elect of the Workers’ Compensation Section of the State Bar of Texas

In his youth, he was a Pathfinder with the 82nd Airborne Division.  In addition to the practice of law, Bob enjoys playing guitar and physical activities, participating in various fun runs, Warrior Dashes and Spartan Races. He is active in CrossFit.
